The European Commission’s modernised Standard Contractual Clauses (SCCs) for data transfers have implications for consent, accessibility, portability and transparency. The deadlines for compliance are fast approaching, as are the fines for those not complying.

 

By 27 December 2022, the new SCCs need to be incorporated into all international data transfer agreements from controllers or processors in the EU/EEA. Any existing agreements incorporating the former SCCs need to be replaced by this date.

Failing to comply with these requirements may lead to fines of 4% of annual turnover of European Companies. Firms must update the SCCs with their non-European providers or partners to avoid such sanctions.
